Our policy
We respect copyright and expect players to do the same. Players can upload a profile photo; only upload one you took yourself or have permission to use. We respond to notices of claimed infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and Kenya's Copyright Act, and remove infringing photos quickly.
Report a photo in the app
Open the player's card and tap Report photo. That opens a support request where our team replies. For a copyright complaint we'll ask for anything below that's missing before we act.
Send a copyright notice
Write to the contact below. Your notice must include:
- Your physical or electronic signature, as the copyright owner or a person authorised to act for them.
- The copyrighted work you say is infringed (for example a link to your original photo or artwork).
- The photo you want removed and enough to find it: the player's name as shown in the app and, if you can, where you saw it.
- Your name, postal address, phone number and email address.
- A statement that you believe in good faith that the use isn't authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
Knowingly misrepresenting that something infringes can make you liable for damages (17 U.S.C. § 512(f)).
What happens next
We remove or block the photo, tell the player who uploaded it, and record a copyright strike on their account. We keep the removed photo for 30 days in case of a counter-notice.
Counter-notice
If your photo was removed and you believe that was a mistake or a misidentification, send us a counter-notice with:
- Your physical or electronic signature.
- The photo that was removed (the date we told you it was removed is enough).
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for your address (or, if you're outside the United States, any judicial district where we may be found), and that you'll accept service of process from the person who sent the notice or their agent.
We send a copy to the person who complained. Unless they tell us within 10 business days that they've gone to court, we put the photo back within 10 to 14 business days of your counter-notice and withdraw the strike.
Repeat infringers
Each photo removed for copyright is one strike. With 3 strikes on your account, you can no longer upload profile photos, and in appropriate circumstances we close the account (any money in your wallet is still paid out to you). Strikes withdrawn after a successful counter-notice or a withdrawn complaint don't count.
Other photo problems
Photos that impersonate someone, or are explicit, hateful or abusive, also break our rules: report them the same way. We remove them without a copyright strike. Questions: support@8ballpesa.com.
